Welcome to Transit Pulse NYC. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Transit Pulse NYC, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
Transit Pulse NYC provides real-time transit information for New York City subway and bus services. The App allows you to:
- View real-time arrival times for subway trains and buses
- Save favorite stations and stops for quick access
- Receive push notifications about arrivals and service alerts
- Access transit information via home screen and lock screen widgets
3. User Responsibilities
When using Transit Pulse NYC, you agree to:
- Use the App only for its intended purpose of viewing transit information
- Not attempt to reverse engineer, modify, or create derivative works of the App
- Not use the App in any way that could damage, disable, or impair the service
- Not use the App for any unlawful purpose
- Verify transit information independently when making time-sensitive decisions
4. Intellectual Property
Transit Pulse NYC and its original content, features, and functionality are owned by Transit Pulse NYC and are protected by international copyright, trademark, and other intellectual property laws.
- The Transit Pulse NYC name, logo, and all related names, logos, and slogans are trademarks of Transit Pulse NYC
- MTA and related transit data are provided by the Metropolitan Transportation Authority and are subject to their terms of use
- You may not copy, modify, distribute, sell, or lease any part of our App without permission
5. Disclaimers
Data Accuracy: Transit Pulse NYC displays real-time data provided by the MTA. While we strive to present this information accurately, we cannot guarantee the accuracy, completeness, or timeliness of the transit data. The MTA is the authoritative source for all transit information.
Service Availability: The App depends on MTA data feeds and network connectivity. Service may be interrupted due to factors beyond our control, including MTA system issues, network outages, or maintenance.
"As Is" Service: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSIT PULSE NYC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any damages resulting from missed trains, buses, or other transit connections
- Any damages resulting from reliance on information provided by the App
- Any damages exceeding the amount you paid for the App (if any)
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.
7. Indemnification
You agree to indemnify and hold harmless Transit Pulse NYC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by:
- Posting the updated Terms in the App
- Updating the "Effective Date" at the top of this document
Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
9. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in New York County, New York.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Transit Pulse NYC regarding your use of the App.
